Scope of this Policy

How to Submit a DMCA Notice

If you believe that material on modernheadline.com infringes your copyright, you must send a written DMCA notice to our Copyright Agent. Only the copyright owner or an authorized representative may submit a valid notice.

Required Information in a DMCA Notice

To be effective under the DMCA, your notice must include all of the following information:
  • Your full name, mailing address, telephone number, and email address
  • Identification of the copyrighted work that you claim has been infringed, or a representative list if multiple works are covered by a single notice

Our Response to DMCA Notices

After receiving a valid DMCA notice, we will review the claim and may remove or disable access to the disputed material. Where appropriate, we will notify the user or party that provided the material so they have an opportunity to submit a counter notification.

Counter Notification

If your content has been removed in response to a DMCA notice and you believe the removal was a mistake or that you are authorized to use the material, you may submit a counter notification to our Copyright Agent. Your counter notification must include:
  • Your full name, mailing address, telephone number, and email address
  • Identification of the material that was removed and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  • A statement that you consent to the jurisdiction of the federal court in your district of residence, or if outside the United States then the federal courts located where The Modern Headline is based, and that you will accept service of process from the person who submitted the original DMCA notice
  • Your physical or electronic signature
Upon receipt of a valid counter notification, we may restore the material unless the original complaining party informs us that they have filed a legal action seeking a court order to keep the material removed.

Repeat Infringers

The Modern Headline may, in appropriate circumstances and at our discretion, limit access for or terminate relationships with users, contributors, or partners who are determined to be repeat infringers.

Misrepresentations

Submitting false or bad faith DMCA notices or counter notifications may carry legal consequences. Parties who misrepresent that material is infringing or was removed in error may be liable for damages and costs, including attorney fees.
